Google Workspace Individual Additional Terms of Service

    • 1. Introduction

    • Google Workspace Individual gives you access to Google Workspace products (with certain features and enhancements) and customer support, as described in Section 2 (General Description).

      To use and access Google Workspace Individual, you must accept the Google Terms of Service (“Google TOS”) and these Google Workspace Individual Additional Terms of Service (“GWI Additional Terms”). The Data Processing Addendum (“DPA”) may also be part of these GWI Additional Terms, as described in Section 4 (Privacy).

      Please read the Google TOS and these GWI Additional Terms carefully. They establish what you can expect from us when you use Google Workspace Individual, and what we expect from you.

      If these GWI Additional Terms conflict with the Google TOS, then, unless you’re in France, these GWI Additional Terms take precedence in relation to Google Workspace Individual.

      These GWI Additional Terms only apply to Google Workspace Individual. If you’re using other Google products or services (whether through the account you use to access Google Workspace Individual or otherwise), separate terms will apply and may identify a different Google contracting entity or service provider.

    • 2. General Description

    • Google Workspace Individual allows you to use the Google Workspace products listed below, together with the premium productivity features and enhancements described at https://workspace.google.com/individual/ (“GWI Products”):

      • Gmail

      • Google Calendar

      • Google Docs

      • Google Sheets

      • Google Slides

      • Google Forms

      • Google Drive

      • Google Chat

      • Google Meet

      • Google Jamboard

      • Google Tasks

    • Google Workspace Individual also allows you to access customer support for the products listed above (“GWI Customer Support”), as described in Section 5 (Customer Support).

      We reserve the right to make changes to Google Workspace Individual, such as to provide more or different features for GWI Products. We may also give you early access to new or enhanced features for GWI Products that are still in development (“Pre-GA Releases”), as described in Section 7 (Pre-General Availability Releases).

      We’ll give you advance notice as described in the Google TOS if there are material changes that negatively impact your use of Google Workspace Individual, except in relation to Pre-GA Releases which may be suspended or discontinued at any time without advance notice.

    • 3. Your Relationship with Google

    • You’re contracting for Google Workspace Individual with the entity described below, and when the Google TOS, these GWI Additional Terms, Google’s Privacy Policy, or the DPA refer to “Google,” “we,” “us,” “our,” or the “data controller,” they mean that entity in relation to your use of Google Workspace Individual (even if the Google TOS or Privacy Policy states otherwise):

      Google Cloud EMEA Limited, a company organized under the laws of Ireland with its address at 70 Sir John Rogerson’s Quay, Dublin 2, Ireland

      Asia Pacific (except Australia and New Zealand)

      Google Asia Pacific Pte. Ltd., a company organized under the laws of Singapore with its address at 70 Pasir Panjang Road, #03-71, Mapletree Business City II Singapore 117371

      Australia

      Google Australia Pty Ltd., a company organized under the laws of Australia with its address at Level 5, 48 Pirrama Road, Pyrmont, NSW 2009, Australia

      New Zealand

      Google New Zealand Limited, a company organized under the laws of New Zealand with its address at PWC Tower, Level 27, 188 Quay Street, Auckland, New Zealand 1010

      United States and any other location not covered above

      The entity identified in the Google TOS

    • Google Workspace Individual is provided to you by the applicable contracting entity listed above, unless you’re in Australia or New Zealand. If you’re in Australia or New Zealand, Google Asia Pacific Pte Ltd. is your service provider (even if the Google TOS states otherwise) and has authorized Google Australia Pty Ltd. as its reseller in Australia and Google New Zealand Limited as its reseller in New Zealand.

      Nothing in these GWI Additional Terms affects or changes the contracting entity or service provider of any other Google products or services you may also use.

    • 4. Privacy

    • We encourage you to read Google’s Privacy Policy (although it’s not part of these GWI Additional Terms), to better understand how we protect your personal data, as a controller under applicable law, when you use Google Workspace Individual including when you access GWI Customer Support.

      We may also send you service announcements, administrative messages, and other information related to your use of Google Workspace Individual, as well as emails and device notifications associated with your subscription. You may opt out of some of those communications.

      If you use GWI Products other than for purely personal or household activities (e.g. if you use GWI Products for business purposes), then we will protect your personal data, as a processor under applicable law, as described in the DPA (which will be part of these GWI Additional Terms). Learn more. In this case, you will also have important obligations under the DPA, so please read it carefully.

      If you use Google Workspace Individual to record audio or video communications, you’re responsible for obtaining the consent of all participants if required by applicable law or regulation.

    • 5. Customer Support

    • If GWI Customer Support is unable to resolve your support issues (e.g., because your request does not relate to GWI Products), you may be transferred or redirected to another Google customer support service.

      If your Google Workspace Individual subscription is cancelled or suspended, your unresolved GWI Customer Support issues may also be suspended, and you may need to start a new inquiry once you’ve reinstated your subscription.

    • 6. Price Changes

    • We may change the Google Workspace Individual price(s) applicable to future billing periods if we give you at least 30 days’ notice of any price increase. These changes won’t affect the price(s) applicable to your current billing period. If you object to any price increase, you should follow the steps we’ll describe in our price increase notice to cancel your subscription. Unless you cancel in this way, the new price will take effect either (a) when payment for your next billing period is due; or (b) if we notify you of the price change less than 30 days before the start of your next billing period, when payment is due for the billing period after your next billing period.

    • 7. Pre-General Availability Releases

    • Pre-GA Releases will be listed here or otherwise identified as "Early Access," "Alpha," "Beta," "Preview," or a similar designation. Your use of Pre-GA Releases is optional: you don’t need to use any Pre-GA Releases in order to use other GWI Products.

      You acknowledge that Pre-GA Releases are being tested by Google, and may be prone to errors or inaccuracies. GWI Customer Support may not be available for Pre-GA Releases.

      For purposes of the Pre-GA Releases, you also instruct Google to process your personal data (defined as “Partner Personal Data” in the DPA) in accordance with applicable law to improve GWI Products (even if the DPA says otherwise).

    • 8. Cancellation

    • You may cancel your Google Workspace Individual subscription at any time by visiting pay.google.com and initiating cancellation under “Subscriptions & Services.” If you cancel in this way, you’ll retain access to Google Workspace Individual until the end of your current billing period, and your access to other Google products and services won’t be affected.

    • 9. Withdrawal Right for EEA Consumers

    • If you’re a consumer in the EEA, then, in addition to your cancellation right under Section 8 (Cancellation), applicable law gives you the standard withdrawal right in Section 9.1 (EU Model Withdrawal Instructions). Any consumer in the EEA who wishes to exercise this withdrawal right may (but is not required to) complete and return the optional standard form provided in Section 9.2 (EU Model Withdrawal Form).

      • 9.1 EU Model Withdrawal Instructions

        • Right of Withdrawal

          If you’re a consumer in the EEA, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days of the conclusion of the contract.

          To exercise the right of withdrawal, you must inform us (Google Cloud EMEA Limited, Attention Google Workspace Individual Customer Support, 70 Sir John Rogerson’s Quay, Dublin 2, Ireland or via email to gwi-eu-support@google.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached Model Withdrawal Form, but it is not obligatory.

          To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

        • Effects of Withdrawal

          If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

          If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

      • 9.2 EU Model Withdrawal Form

    • Please read the Google TOS to understand the terms and law that will govern any legal dispute relating to Google Workspace Individual or these GWI Additional Terms.
