GOOGLE EECC WAIVER

Introduction
Under the European Electronic Communication Code (an EU Directive entering into force on 21 December 2020) ("EECC"), businesses that are microenterprises, small enterprises and not for profits (each as defined above) are entitled to benefit from certain consumer protections when they procure services falling within the definition of an "electronic communications service" in the EECC.
Those consumer protections include rights to receive specific pre-contractual information and contract summaries and to extend maximum contract durations to bundles of services. The EECC however accepts that these additional protections may not be needed by microenterprises, small enterprises and not for profits, and allows these organisations to waive these rights.
If your organization falls into any of these categories, you may waive these rights as permitted by the EECC by accepting this waiver. In no way do we see this waiver as diluting any of your contractual rights, and it allows us to offer more adaptable, unified and simplified contractual terms to you and other customers.
Please be aware that if you do not accept this waiver, we will not be able to provide you with Google Workspace under the Workspace Terms of Service, although you may be able to procure some or all of the Google Workspace services separately.
Waiver

As a microenterprise, small enterprise or not for profit, you agree to waive any rights you may have under:

a. Article 102(1) EECC to receive certain pre-contractual information;
This information is already available on our
website for all Workspace services. -
b. Article 102(3) EECC to receive a contract summary;
This information, including a summary description of each Google Workspace service and the Google Workspace pricing options, is already available on our
website . -
c. Article 105(1) EECC, which limits the maximum contract duration to 24 months; and
This right applies if you are purchasing Google Voice, and would prevent us from offering you a range of different contract length and pricing options, and allowing you to choose the option that best meets your needs. Since longer contract durations often allow better prices, we wouldn't want to limit flexibility on contract length for either party.

d. Article 107(1) EECC, which extends other rights in the EECC (including Article 102(3) and 105(1) as described above) to all services provided under the same Google Workspace Agreement.
The Article 107(1) right applies if you are purchasing Google Voice. If it applies, It would (i) require us to provide information that is already available on our
website for the other Google Workspace products you are purchasing under the same agreement and limit the contract duration for those other products, and (ii) limit our ability to offer a broad range of pricing options for those other products. As indicated above, we would not want to limit flexibility on contract length or pricing for either party.
