Google Workspace Individual User Terms of Service (No Verified Domain Administrator)

Welcome! You are signing up for an individual Google Workspace account, but do not yet have a verified Domain Administrator. The following terms, in addition to the Google Terms of Service and the Google Privacy Policy (together, the “Terms”) will govern your use of Google Workspace until a Domain Administrator verifies control of accounts on the Organization Domain. Please read these terms carefully, and check from time to time for updates. If you are accepting on behalf of your employer or another entity, you represent and warrant that you have full legal authority to bind your employer or such entity to these terms and conditions. If you do not wish to agree to the Terms, or if you don’t have the legal authority to bind your employer or the entity agreeing to these terms, please do not sign up for an individual Google Workspace account.

  • 1. Scope

    • The Terms apply to any use of Google’s services or products using your individual Google Workspace account for business purposes, including the Google Workspace Core Services and Additional Google Services (together, the “Services”). For some Services, you may be asked to read, agree to, and accept additional terms. If you agree to and accept service-specific additional terms, those additional terms become part of your agreement with Google. If you do not agree to or accept the service-specific additional terms, then you will not be able to use some of the Services.

  • 2. Domain Email Address for Access

    • To sign up for an individual Google Workspace account, you must verify that you have access to the Domain Email Address. Google may verify from time to time that you have access to the Domain Email Address. If you do not have access to the Domain Email Address, then Google will have no obligation to provide you with the Services.

  • 3. Compliance with Contracts or Policies

    • You are solely responsible for ensuring that your use of the Services, including the content and handling of any Organization Data, complies with any applicable contract terms or policies. If you use your work email address to create your account, these may include your employment contract terms or your employer’s policies regarding technology usage, security, or confidentiality. Please verify that any applicable contract terms or policies permit you to use the Services and that you have obtained any required authorization.

  • 4. Acceptable Use

    • Use of the Services is subject to the Acceptable Use Policy. Failure to use the Services in a manner consistent with the Acceptable Use Policy may result in suspension or termination of your account, at Google’s sole discretion.

  • 5. Restrictions on Use

    • Unless Google specifically agrees in writing, you must not, and must use commercially reasonable efforts to make sure a third party does not: (a) sell, resell or lease the Services to a third party or otherwise make the Services available on a paid basis to a third party; (b) attempt to reverse engineer the Services or any component; (c) attempt to create a substitute or similar service through use of, or access to, the Services; (d) use the Services for High Risk Activities; (e) use the Services to store or transfer any Organization Data that is controlled for export under Export Control Laws; or (f) use the Services in connection with any protected health information subject to the Health Insurance Portability and Accountability Act of 1996 and the rules and regulations thereunder ("HIPAA").

  • 6. Compliance with Laws

    • Where applicable, you are solely responsible for compliance with all laws and regulations that apply to your use of the Services, such as copyright laws, data protection laws, the U.S. Family Educational Rights and Privacy Protection Act of 1974 (FERPA), Children’s Internet Protection Act (CIPA), and the Children’s Online Privacy Protection Act of 1998 (COPPA), including obtaining parental consent concerning any collection or dissemination of personal information of students or children.

  • 7. Collaboration

    • The Services are designed to be collaborative in nature and facilitate sharing Organization Data with others. Your Profile Information will be visible to all End Users on the Organization Domain, including any future End Users on the Organization Domain. If you opt to share Organization Data with a group of End Users, such data will be shared with all current and future members of that group. You are solely responsible for having the necessary rights or permissions to share any Organization Data that you share.

  • 8. Team Administration

    • You may be invited by a Team Administrator to join a Managed Team. If you opt to join a Managed Team, your use of the Services will be managed by one or more Team Administrators as long as you are a member of the Managed Team.

      • 1. Team Administrator Capabilities. If you opt to join a Managed Team, your Team Administrators will have access to your Google Workspace account information (including your settings and data stored as part of your account). Your Team Administrators may be able to: (i) access, monitor, use, remove, or disclose your data; (ii) modify your settings; (iii) restrict your ability to access information or settings; (iv) restrict your ability to disassociate your account or data from the Managed Team; or (v) suspend or terminate your access to the Services.

      • 2. Consent to Team Administration. You agree to allow: (i) Team Administrators to have the access and capabilities described in these Terms; and (ii) Google to provide Team Administrators with the access and capabilities described in these Terms. You are solely responsible for ensuring that you have the necessary rights or permissions to allow Team Administrators to access your data.

  • 9. Domain Administration

    • Because you are using a Domain Email Address for your individual Google Workspace account, a Domain Administrator that verifies control of the Organization Domain can opt to manage your Google Workspace account at any time.

      • 1. Domain Administrator Capabilities. If your Google Workspace account becomes managed by one or more Domain Administrators, your Domain Administrators will have access to your Google Workspace account information (including your settings and data stored as part of your account). Your Domain Administrators may be able to: (i) access, monitor, use, remove, or disclose your data; (ii) modify your settings; (iii) restrict your ability to access information or settings; (iv) restrict your ability to disassociate your account or data from domain administration; (v) remove or disable any Services or Products you have enabled, used, downloaded, or installed; (vi) change your account password; or (vii) suspend or terminate your account.

      • 2. Consent to Domain Administration. You agree to allow: (i) Domain Administrators to have the access and capabilities described in these Terms; and (ii) Google to provide Domain Administrators with the access and capabilities described in these Terms. You are solely responsible for ensuring that you have the necessary rights or permissions to allow Domain Administrators to access your data.

      • 3. Control of Organization Domain. Because any person or entity that verifies control of the Organization Domain may gain access to your Google Workspace account as a Domain Administrator, please keep yourself informed of any changes in ownership or control of the Organization Domain.

      • 4. Removing Personal Data; Notification Before Domain Administration. Unless your Google Workspace account has been suspended or terminated in accordance with these Terms, you may choose to remove or delete your personal data at any time before a Domain Administrator verifies control of the Organization Domain and gains access to your account via the Domain Admin Console. You are solely responsible for permanently deleting any data that should not be accessible to a Domain Administrator. Unless the Domain Administrator is already a Team Administrator for your Managed Team, Google will notify you through your Domain Email Address and Recovery Email Address (if you’ve provided one) before a Domain Administrator gains access to your Google Workspace account.

      • 5. Paid Services or Products. Because a Domain Administrator with access to your Google Workspace account may remove or disable any Services or Products you have purchased at any time, any purchase you make while using the Services is at your own risk.

  • 10. Termination Due to Domain Administration

    • Once a Domain Administrator verifies control of the Organization Domain and gains access to your Google Workspace account via the Domain Admin Console, these Google Workspace Individual User Terms automatically terminate. To the extent that your Domain Administrator allows you to continue using one or more Additional Google Services, the Google Terms of Service, Google Privacy Policy, and any service-specific terms will continue to apply to your use of such Additional Google Services.

  • 11. Effects of Termination Due to Domain Administration

    • If these Google Workspace Individual User Terms terminate due to Domain Administration, then (a) the rights granted by one party to the other will cease immediately (except as set forth in Sections 10 and 11); and (b) Google will notify you through your Domain Email Address and Recovery Email Address (if you’ve provided one) that you have a Domain Administrator. Once a Domain Administrator gains access to your Google Workspace account, (a) your Google Workspace account will be managed by the Domain Administrator; (b) Organization Data will be controlled by the Domain Administrator; and (c) any use of the Services by you will be determined by your Domain Administrator and governed by the Domain Administrator’s Domain Admin Agreement with Google.

  • 12. Miscellaneous

    • 1. No Technical Support Services for End Users. Google will not provide technical support services to End Users under these Google Workspace Individual User Terms of Service. If you are a member of a Managed Team, you may direct questions and complaints relating to your use of the Google Workspace Core Services to your Team Administrators. Team Administrators may receive technical support services from Google under the applicable G Suite Business (Team Managed) Agreement.

    • 2. Interpretation of Conflicting Terms. If there is a conflict between the documents that make up these Terms, the documents will control in the following order: the Google Workspace Individual User Terms, any service-specific terms to which you agree for a Service, the Google Terms of Service, the Google Privacy Policy, and the terms located at any URL.

    • 3. Modifications. Google may modify these Terms from time to time in accordance with the Google Terms of Service.

  • 13. Definitions

    • "Acceptable Use Policy" means the acceptable use policy for the Services available at https://www.google.com/a/help/admins/use_policy.html (or such other URL as Google may provide), and as updated or modified by Google from time to time.

    • "Additional Google Services" means the additional Google services that may be accessible to you using your Google Workspace account but are not Google Workspace Core Services. Additional Google Services are described here: https://support.google.com/a/answer/181865, (or such other URL as Google may provide), and as updated or modified by Google from time to time.

    • "Admin Console" means the online tool provided by Google to customers to perform certain administration functions.

    • "Domain Admin Agreement" means an agreement for the use or provision of Google services between Google and the person(s) or entity that verifies control of the Organization Domain, such as a Google Workspace Agreement.

    • "Domain Admin Console" means the version of the Admin Console that Google provides to Domain Administrators.

    • "Domain Administrator" means the person(s) or entity that administers the Services to you after: (i) verifying control of the Organization Domain and (ii) entering into a Domain Admin Agreement with Google.

    • "Domain Email Address" means the email address on the Organization Domain that you will use in connection with the Services. Your username for the Services will be the same as the Domain Email Address.

    • "End User" means any individual using the Services from an account on the Organization Domain.

    • "Export Control Laws" means all applicable export and re-export control laws and regulations, including trade and economic sanctions maintained by the Treasury Department’s Office of Foreign Assets Control, and the International Traffic in Arms Regulations ("ITAR") maintained by the Department of State.

    • "Google Workspace Core Services" means the applicable Google Workspace services described here: https://www.google.com/apps/terms/user_features.html, (or such other URL as Google may provide), and as updated or modified by Google from time to time. Some Google Workspace Core Services may not be available to End Users until a Domain Administrator verifies control of the Organization Domain.

    • "High Risk Activities" means uses such as the operation of nuclear facilities, air traffic control, or life support systems, where the use or failure of the Services could lead to death, personal injury, or environmental damage.

    • "Managed Team" means a group of one or more End Users on the Organization Domain whose use of the Services is administered by one or more Team Administrators.

    • "Organization Data" means data provided, generated, transmitted, or displayed via the Services by you or by other End Users on the Organization Domain.

    • "Organization Domain" means the domain that will be used in connection with the Services.

    • "Products" means data files, applications, written text, mobile device software, music, audio files or other sounds, photographs, videos, images, or other digital content that is downloaded or installed to your account.

    • "Profile Information" means the information contained in your Google Workspace account profile, including your full name and email address.

    • "Recovery Email Address" means an email address not on the Organization Domain that you may designate to receive certain email communications from Google. You may change this email address through your account settings.

    • "Team Administrator" means the person(s) or entity that administers the Services to End Users in a Managed Team. A Team Administrator can become a Domain Administrator by verifying control of the Organization Domain and entering into a Domain Admin Agreement with Google.
